Please read these Terms of Service ("Agreement," "Terms") carefully before using the travel booking services, website, or customer support channels operated by WOW MY FLIGHT LLC ("Company," "we," "us," or "our"). By accessing or using our services, booking a flight, or making a payment, you agree to be bound by these Terms.
1. Agency Status & Role
WOW MY FLIGHT LLC operates as an independent travel agent and flight reseller. We act solely as an intermediary between you (the "Customer" or "Passenger") and third-party travel providers, including commercial airlines, flight consolidators, and wholesalers ("Suppliers"). Disclaimer of Supplier Liability: We do not own, operate, manage, or control the aircraft, flight schedules, or operational policies of any airline. We are not liable for flight delays, cancellations, overbookings, mechanical failures, strikes, baggage loss, weather disruptions, or personal injuries caused by third-party Suppliers.
2. Passports, Visas & Entry Requirements
- Passenger Responsibility: It is the sole responsibility of the passenger to ensure they possess valid travel documentation, including passports, transit visas, entry visas, health certificates, and vaccination records required by destination or transit countries.
- Passport Validity: Most international destinations require passports to remain valid for at least six (6) months beyond your scheduled return date.
- Denial of Boarding: WOW MY FLIGHT LLC bears no liability or financial responsibility if an airline or border authority denies you boarding or entry due to invalid, expired, or missing travel documentation.
3. Booking, Fares & Ticketing
- Price Volatility: All flight quotes, airfares, and seat availability displayed or quoted by our agents are subject to change without prior notice until an official electronic ticket (e-ticket) is issued.
- Net Fares & Markups: Transportation Security Administration (TSA), U.S. Customs and Border Protection (CBP), and relevant international immigration/civil aviation authorities as required by law.
- Ticket Issuance: A booking request or payment authorization does not guarantee ticket issuance. A contract is formed only once payment is verified, funds clear, and an e-ticket number is generated.
4. Payments, Credit Cards & Fraud Verification
- Form of Payment: We accept major credit cards, debit cards, and authorized bank wires. By providing credit card details, you confirm that you are the authorized cardholder or have explicit legal authorization from the cardholder to authorize the charges.
- Third-Party Card Authorizations: If the credit card holder is not a traveling passenger, we reserve the right to request a completed Credit Card Authorization Form alongside copy verification of the cardholder’s passport or government photo ID.
- Chargeback Policy: Fraudulent chargebacks, improper credit card disputes, or non-payment of legitimate purchases will be subject to collection proceedings, administrative service fees, legal costs, and reporting to major credit rating agencies.
5. Cancellations, Exchanges & Refunds
- Airline Fare Rules: All tickets issued by WOW MY FLIGHT LLC are governed by the specific Fare Rules and Contract of Carriage established by the issuing airline. Many discounted, consolidated, or promotional business class tickets are non-refundable or subject to strict airline penalty fees for changes or cancellations.
- Agency Processing Fees: In addition to airline-imposed penalties, WOW MY FLIGHT LLC charges a non-refundable administrative fee for processing ticket exchanges ($100 per passenger) or cancellation/refund requests ($150 per passenger).
- Schedule Changes: Airlines reserve the right to cancel, divert, or alter flight schedules. While we will assist in processing schedule changes, we are not responsible for schedule modifications implemented directly by the carrier.
6. Airline Tariff Regulations & Booking Abuse
Passengers explicitly agree not to engage in prohibited airline ticketing practices, including:
- Hidden-City / Point-Beyond Ticketing: Purchasing a ticket with a segment you do not intend to fly in order to obtain lower airfares.
- Back-to-Back Ticketing: Combining two or more round-trip tickets to circumvent minimum stay requirements.
- Duplicate Bookings & Churning: Creating multiple active bookings for the same passenger across identical dates or repeatedly holding and canceling seats.
Airlines strictly monitor these practices and reserve the right to cancel tickets, confiscate frequent flyer miles, or issue debit memos. The passenger agrees to fully indemnify WOW MY FLIGHT LLC against any financial penalties, losses, or airline debit memos resulting from prohibited booking practices.
7. Limitation of Liability & Indemnification
- Limitation: To the maximum extent permitted by applicable law, WOW MY FLIGHT LLC, its managers, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages resulting from your use of our services or any travel supplier default.
- Indemnification: You agree to defend, indemnify, and hold harmless WOW MY FLIGHT LLC from any claims, liabilities, costs, losses, or legal expenses arising from your breach of these Terms, violation of airline rules, or failure to secure proper travel documentation.
8. Governing Law & Dispute Resolution
These Terms of Service and any contractual disputes shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Pinellas County, Florida.
9. Refund, Cancellation & Chargeback Policy
Operating Entity: WOW MY FLIGHT LLC (“Agency,” “We,” “Us,” or “Our”) · Effective Date: October 2, 2026
9.1 Agency Scope of Service & Disclaimer of Carrier Control
- 9.1.1 Independent Travel Intermediary Status: WOW MY FLIGHT LLC operates strictly as an independent travel agent arranging air transportation and travel services on behalf of third-party air carriers (“Operating Carriers”). We are not an air carrier and do not operate flights.
- 9.1.2 Governing Carrier Conditions: Every ticket booked through Our Agency is subject to the individual Contract of Carriage, Fare Rules, and operational policies of the respective Operating Carrier. The Agency has no administrative control over airline schedule changes, flight delays, mechanical cancellations, seat reassignments, or baggage allowances.
- 9.1.3 Non-Transferability: Air travel tickets issued through Our Agency are strictly non-transferable and non-endorsable. Passenger name corrections or modifications are strictly governed by carrier rules and are generally prohibited once a ticket has been ticketed/issued.
9.2 Cancellations, Fare Rules & Refund Eligibility
- 9.2.1 Presumption of Non-Refundable Fares: Unless expressly labeled as a “Fully Refundable Ticket” in writing prior to purchase confirmation, all tickets distributed through Our Agency are strictly non-refundable, non-changeable, and non-assignable after issuance.
- 9.2.2 U.S. Department of Transportation (DOT) 24-Hour Rule Exemption Notice: For reservations originating in or departing from the United States booked at least seven (7) days prior to scheduled departure, cancellations requested within 24 hours of booking confirmation may be eligible for a refund or void status under U.S. DOT guidelines. All 24-hour void requests remain subject to an administrative agency service handling fee of up to $50.00 USD per ticket.
- 9.2.3 Voluntary Passenger Cancellations & Ticket Changes: If a passenger voluntarily requests to cancel or modify a ticket outside the 24-hour window, the transaction remains subject to the Operating Carrier’s Published Change/Cancellation Penalties (which frequently equal 100% of ticket value). Any remaining residual fare balance, if permitted by carrier rules, will be issued solely as a restricted future airline credit bound by the carrier’s expiration timeline.
- Agency Service Fees Non-Refundable: All booking fees, service fees, platform charges, and merchant processing surcharges collected by WOW MY FLIGHT LLC are completely non-refundable under all circumstances.
- 9.2.4 Involuntary Cancellations & Schedule Modifications: In the event of an airline-initiated flight cancellation, weather grounding, labor dispute, or carrier schedule modification, passenger rights to refunds or rebooking options are dictated exclusively by the Operating Carrier’s Contract of Carriage. Agency service fees remain non-refundable.
9.3 Mandatory Credit Card Security & Verification
- 9.3.1 Fraud Prevention Controls: To safeguard cardholders and satisfy high-risk merchant security mandates, WOW MY FLIGHT LLC utilizes automated Address Verification Services (AVS), 3-Digit Card Verification Value (CVV/CVC) checks, and 3D Secure 2.0 (3DS) two-factor authentication.
- 9.3.2 Third-Party Cardholder Mandate: If the credit/debit cardholder name differs from the primary passenger name on the itinerary, the Agency reserves the right to withhold e-ticket issuance until a signed Third-Party Credit Card Authorization Form, a valid government-issued photo ID, and card image verifications are received and approved.
9.4 Waiver of Chargeback Rights & Dispute Resolution Contract
- 9.4.1 Mandatory Pre-Dispute Contact: By purchasing a ticket through Our Agency, the Cardholder and Passenger agree to exhaust all internal resolution channels with Our support department (support@wowmyflight.com) prior to filing a formal billing dispute or chargeback with their credit card issuing bank.
- 9.4.2 Binding Chargeback Waiver: The Cardholder hereby agrees NOT to initiate, file, or pursue a chargeback, credit card dispute, or payment reversal under any of the following circumstances:
- Unilateral passenger change of travel plans, voluntary cancellations, or “no-show” events.
- Disagreements over non-refundable fare structures previously disclosed at checkout.
- Flight cancellations, delays, or schedule modifications enforced by the Operating Carrier.
- Name submission errors made by the passenger during the online booking process.
- Claims of “unauthorized transaction” where 3D Secure (3DS) authentication was completed or where passenger details match the cardholder’s household/family.
- 9.4.3 Legal Consequences of Improper / Fraudulent Chargebacks: In the event of an improper or fraudulent chargeback filed by the Cardholder, WOW MY FLIGHT LLC will submit this executed contract, IP routing logs, 3DS electronic signatures, GDS ticket transmission logs, and airline flight utilization data to the cardholder’s bank to defeat the dispute.
- The Cardholder agrees to reimburse WOW MY FLIGHT LLC for all merchant arbitration fees ($50.00 – $250.00 USD per incident), administrative chargeback collection costs, and reasonable attorney fees incurred in recovering the disputed funds.
- The Agency reserves the right to immediately invalidate and cancel any open, un-flown flight segments associated with a card account subject to an active chargeback or payment reversal.
9.5 Electronic Assent & Acknowledgement
By checking the mandatory checkbox labeled “I accept the Terms of Service and Refund/Chargeback Policy” and submitting payment, the Cardholder explicitly certifies under penalty of law that:
- They have read, understood, and agreed to these Terms, the Airline Contract of Carriage, and Our Non-Refundable Fare Rules.
- They authorize WOW MY FLIGHT LLC to charge their designated payment card for the total booking sum displayed.
- This electronic confirmation constitutes a legally binding contract under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA).
